1. Acceptance of Terms

By accessing or using InvestBud ('the Platform'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms. We will notify registered users of material changes via email or platform notification.

2. Service Description

InvestBud is a web-based platform for German property investment analysis. Our services include:

• Property investment financial analysis and modeling
• ROI, rental yield, and cash flow calculations
• Closing cost calculations including transfer tax, notary fees, and broker fees
• Tax optimization analysis including depreciation calculations
• Multi-property portfolio comparison
• PDF report generation for investment analyses
• Investment calculators for various German real estate metrics
• Educational resources including glossary and city/state investment guides

3. User Accounts

To access certain features, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

You agree to use the Platform only for lawful purposes. The following activities are prohibited:

• Attempting to gain unauthorized access to the Platform or its systems
• Using automated tools (bots, scrapers) to access the Platform without permission
• Sharing your account credentials with third parties
• Using the Platform to provide investment advisory services without proper licensing
• Reproducing, distributing, or reselling any content from the Platform
• Interfering with or disrupting the Platform's infrastructure
• Uploading malicious code or attempting to compromise Platform security

6. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, calculations, algorithms, and software — are owned by InvestBud and protected by international copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial investment analysis purposes.

Important: The information and analyses provided by InvestBud are for informational purposes only and do NOT constitute:

• Investment advice or recommendations within the meaning of § 34f GewO (German Trade Regulation Act) or the German Securities Trading Act (WpHG)
• Financial, tax, or legal consulting of any kind
• A guarantee of investment returns, property performance, or appreciation
• A substitute for professional advice from qualified and licensed advisors
• Any warranty regarding the accuracy, completeness, or timeliness of the data and calculations provided

InvestBud is NOT a licensed financial investment intermediary pursuant to § 34f GewO and does not provide investment advice. 8. Limitation of Liability

To the maximum extent permitted by applicable law, InvestBud and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment opportunities, arising from your use of or inability to use the Platform. Our total liability for any claims arising from your use of the Platform shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Extended period of account inactivity
• Request by law enforcement or government agencies

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall remain in effect, including intellectual property rights, disclaimers, and limitation of liability.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. For consumers residing in the EU, mandatory consumer protection provisions of your country of residence shall apply. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.
