1. Scope
These Terms of Service ('Terms') apply to all contracts for the use of InvestBud ('the Platform') between its operator, Cengizhan Hakan (details in the imprint), and the users of the Platform. Deviating terms of users only apply if we expressly agree to them. We notify registered users of changes to these Terms by email at least six weeks before they take effect. For existing contracts, amended Terms only apply if you agree to them.
2. Service Description
InvestBud is a web-based platform for German property investment analysis. Our services include:
- Property investment financial analysis and modeling
- ROI, rental yield, and cash flow calculations
- Closing cost calculations including transfer tax, notary fees, and broker fees
- Tax optimization analysis including depreciation calculations
- Multi-property portfolio comparison
- PDF report generation for investment analyses
- Investment calculators for various German real estate metrics
- Educational resources including glossary and city/state investment guides
3. Conclusion of Contract
The plans shown on the Platform are not yet a binding offer. A contract is concluded as follows:
- Free account: you sign up with your email address or with Google. When you complete the sign-up, a free contract for the use of the Platform is concluded.
- Premium subscription and single analysis: you choose the offer, enter your payment details, accept these Terms and click the order button. This is your binding offer. The contract is concluded as soon as we confirm the order on screen. We then email you a contract confirmation with these Terms and the withdrawal notice.
- Until you click the order button, you can correct your entries with “Back” or cancel the process by closing the window.
- The contract languages are German and English.
- We store your order data (plan, price, date). You can see your plan in your account. You can view, print and save these Terms on this page at any time.
4. User Accounts
To access certain features, you must create an account. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access to your account
If you breach these Terms, we may suspend your account; where reasonable, we warn you first. We may delete a free account that has not been used for two years after telling you by email at least 30 days in advance. We do not delete accounts with a running subscription for inactivity.
5. Subscriptions & Payments
InvestBud offers both free and premium subscription plans:
Free Plan
Includes limited analysis credits and access to basic features. No payment information required.
Premium Plan
Provides unlimited analyses and full access to all features. Available as monthly (€9.99/month) or yearly (€89.99/year) subscriptions.
Billing & Cancellation
- Payments are processed through Stripe.
- New subscribers get a 7-day free trial. If you cancel during the trial, nothing is charged.
- Monthly plan: it renews for one month at a time unless you cancel by the end of the running month.
- Yearly plan: after the trial it first runs for one year. If you do not cancel by the end of that year, it continues for an indefinite term and is still billed yearly in advance. You can then cancel it at any time with one month’s notice; we refund the amount for the time after the contract ends pro rata.
- You can cancel at any time: with “Cancel contracts here” at the bottom of every page, in your account under “Manage subscription” or by email to [email protected].
- You keep Premium access until the contract ends.
- Your statutory right of withdrawal is not affected (see the withdrawal notice).
6. Acceptable Use
You agree to use the Platform only for lawful purposes. The following activities are prohibited:
- Attempting to gain unauthorized access to the Platform or its systems
- Using automated tools (bots, scrapers) to access the Platform without permission
- Sharing your account credentials with third parties
- Using the Platform to provide investment advisory services without proper licensing
- Reproducing, distributing, or reselling any content from the Platform
- Interfering with or disrupting the Platform's infrastructure
- Uploading malicious code or attempting to compromise Platform security
7. Intellectual Property
All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, calculations, algorithms, and software — are owned by InvestBud and protected by international copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial investment analysis purposes.
8. Disclaimers & No Investment Advice
Important: The information and analyses provided by InvestBud are for informational purposes only and do NOT constitute:
- Investment advice or recommendations within the meaning of § 34f GewO (German Trade Regulation Act) or the German Securities Trading Act (WpHG)
- Financial, tax, or legal consulting of any kind
- A guarantee of investment returns, property performance, or appreciation
- A substitute for professional advice from qualified and licensed advisors
- Any warranty regarding the accuracy, completeness, or timeliness of the data and calculations provided
InvestBud is NOT a licensed financial investment intermediary pursuant to § 34f GewO and does not provide investment advice. Property investment involves significant financial risk, including the possible total loss of invested capital. Past performance does not guarantee future results. All calculations are based solely on user-provided inputs and assumptions and are provided 'as-is' without warranty. Actual results may vary significantly. Tax calculations and depreciation figures are approximations and do not replace advice from a qualified tax advisor. The user bears sole responsibility for their investment decisions. Always consult qualified financial, tax, and legal professionals before making investment decisions.
9. Limitation of Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence, we are only liable for the breach of essential contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case our liability is limited to the damage that was foreseeable and typical for the contract when it was concluded. Otherwise, liability for slight negligence is excluded. These rules also apply to our vicarious agents.
10. Termination
We may terminate free accounts with two weeks’ notice. We may terminate a subscription with one month’s notice to the end of a billing period; we refund amounts paid in advance for the time after that pro rata. Either party may terminate without notice for good cause. Good cause for us includes in particular:
- a serious breach of these Terms, or one continued after a warning
- fraudulent or unlawful use of the Platform
- being in arrears with a subscription fee despite a reminder
- an order by an authority or a court
When the contract ends, your right to use the services concerned ends. Provisions that by their nature continue to apply, such as those on liability, remain in effect. Section 5 sets out how you can cancel.
11. Governing Law & Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Berlin. For consumers, the statutory places of jurisdiction apply.
